1. SCOPE
These Terms of Use govern the use of the "Bäume in Wien" app (hereinafter "App") and its community features. By using the App, you agree to these terms.

2. SERVICE DESCRIPTION
The App offers the following features:
- Tree Map: Interactive map of all 230,620 city trees in Vienna (Data source: City of Vienna Open Data, CC BY 4.0)
- Community Trees: Users can report trees not included in the official registry
- Tree Rally: Gamified tree discovery
- Favorites & Notes: Personal tree collection
- AR Mode: Augmented reality view (Beta)
The App is free, ad-free, and contains no in-app purchases.
3. REGISTRATION & ACCOUNT
3.1 Account Types
- Without account: Full access to map, favorites, notes, rally (local features)
- With account: Additionally report, confirm, and flag community trees
3.2 Registration
- Email address and password, or OAuth (Google/GitHub)
- Email verification required
- Minimum age: 16 years (under 16 with parental consent)
3.3 Account Security
- You are responsible for your account security
- Passwords must be at least 6 characters long
- If you suspect misuse: Change your password immediately and contact us
4. COMMUNITY TREES
4.1 Reporting Trees
- Community trees are user-reported trees not included in the official tree registry of the City of Vienna
- The location must be as accurate as possible (GPS or map selection)
- The tree species should be specified to the best of your knowledge
- Reported trees are visible to all users
4.2 Confirming Trees
- Logged-in users can confirm the existence of community trees
- Each user can confirm a tree only once
- Confirmations increase the credibility of an entry
4.3 Flagging Trees
Users can flag entries that:
- Have an incorrect location
- Specify the wrong tree species
- No longer exist
- Constitute spam or abuse
4.4 Verified Trees
- Trees with sufficient confirmations or trees reported by official accounts receive "Verified" status
- The official "Bäume in Wien" account is identified by a verification badge
5. CODE OF CONDUCT
5.1 Permitted
- Report trees honestly and accurately
- Confirm trees you have actually seen
- Flag incorrect entries via the report function
- Use the App for educational purposes (school classes, excursions)
5.2 Prohibited
- False reports: Intentionally reporting wrong tree locations or species
- Spam: Multiple identical or meaningless entries
- Manipulation: Artificially confirming your own entries (e.g., with multiple accounts)
- Abuse: Offensive, inappropriate, or illegal content in comment fields
- Automation: Bots or automated mass entries
- Reverse engineering: Decompilation or modification of the App to the detriment of others
5.3 Consequences
In case of violations, we reserve the right to:
- Remove individual entries
- Temporarily suspend the account
- Permanently delete the account
- Take legal action in severe cases
6. INTELLECTUAL PROPERTY & OPEN SOURCE
6.1 Open Source License
- The app "Bäume in Wien" is an open-source project
- The source code is available on GitHub: github.com/Baume-in-Wien
- The use, modification, and redistribution of the source code is governed by the respective license in the repository
- Contributions to the project are welcome
6.2 Third-Party Data and Licenses
- Tree registry data: City of Vienna (data.wien.gv.at), licensed under CC BY 4.0
- Map data: © OpenStreetMap contributors, ODbL
- Wikipedia content: Wikimedia Foundation, CC BY-SA 3.0 / 4.0
6.3 User Contributions
- Community tree entries are licensed under CC BY 4.0
- You retain copyright to your photos and notes
- By uploading, you grant us a simple, non-exclusive, royalty-free right of use to display the content within the app and to operate the service
7. LIABILITY
7.1 Availability
- The App is provided "as-is"
- We do not guarantee uninterrupted availability
- Maintenance may be performed without prior notice
7.2 Data Accuracy
- Tree registry data originates from the City of Vienna and is displayed unchanged
- Community tree entries are created by users and may contain errors
- We assume no liability for the accuracy of location or species data
7.3 Limitation of Liability
- We are not liable for damages arising from use of the App, to the extent permitted by law
- This applies in particular to damages caused by incorrect location data
- Liability for intent and gross negligence remains unaffected
8. DATA PROTECTION
The processing of personal data is described in our Privacy Policy.
Summary:
- EU servers (GDPR compliant)
- No tracking, no advertising
- Data can be deleted at any time

9. TERMINATION & ACCOUNT DELETION
- You can delete your account at any time (in the App under Settings)
- Your community tree entries remain anonymously (the display name is removed)
- Personal data (email, profile) will be deleted within 30 days
- Local data (favorites, notes) remain on your device and can be deleted manually
10. CHANGES TO TERMS OF USE
- Changes will be announced in the App and on the website
- Continued use after changes constitutes acceptance
- Significant changes will be communicated via email or in-app notification
11. APPLICABLE LAW
- Austrian law applies
- Jurisdiction: Vienna, Austria
- EU dispute resolution: ec.europa.eu/consumers/odr
